1. Terms of Use
Welcome to the Lamb's Florist website (the "Site"). By accessing, browsing, or using this Site in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms & Policies (collectively, the "Agreement"). This Agreement is between you ("you," "your," or "User") and Lamb's Florist ("we," "us," "our," or the "Company"), a floral services business serving Anniston, Alabama and Centre, Alabama.
If you do not agree with any part of this Agreement, you must discontinue use of the Site immediately. We reserve the right to update, modify, or replace any part of this Agreement at our sole discretion by posting revisions on this page. The "Last Revised" date at the top of this page indicates when the most recent changes were made. Your continued use of the Site following the posting of revised terms constitutes your acceptance of those changes.
You represent and warrant that you are at least 18 years of age or have the consent of a parent or legal guardian to use this Site. You agree to use the Site only for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party.
2. Ordering, Pricing & Payment
How to Order
Lamb's Florist operates on a call-to-order basis. This Site serves as a gallery and informational resource. To place an order, please call us directly at (256) 237-9579. Our team will work with you to select the perfect arrangement, confirm details, and arrange payment and delivery. No purchases are made directly through this website.
Pricing
All prices discussed over the phone are quoted in U.S. dollars and are subject to change without prior notice. Prices may vary based on seasonal availability, flower market fluctuations, arrangement size, and customization requests. Applicable state and local taxes will be added to the total. Delivery fees may apply depending on the delivery location and are communicated at the time of ordering.
Payment
Payment methods and terms will be discussed when you place your order by phone. We may accept cash, credit cards, debit cards, or other payment methods at our discretion. Full payment is generally required before or at the time of delivery. For large events such as weddings, a deposit may be required at the time of booking, with the balance due prior to the event date.
Order Confirmation
When you place an order by phone, our staff will verbally confirm the details of your order including arrangement type, delivery date, delivery address, and total price. An order is not considered confirmed until acknowledged by a Lamb's Florist team member. We reserve the right to refuse or cancel any order at our discretion.
3. Delivery Policy
Service Areas
We deliver to addresses within Anniston, Alabama, Centre, Alabama, and select surrounding communities. Delivery availability to locations outside of our primary service areas is subject to approval and may incur additional delivery charges. Please call us to confirm whether we can deliver to your desired address.
Delivery Times
Delivery windows are discussed when you place your order. While we make every reasonable effort to deliver within the agreed-upon timeframe, delivery times are estimates and not guarantees. Delays may occur due to weather conditions, traffic, high order volumes (especially during holidays such as Valentine's Day, Mother's Day, and Easter), or other circumstances beyond our control.
Delivery Acceptance
If no one is available at the delivery address to receive the arrangement, our driver may leave the arrangement in a safe, sheltered location at the delivery address at our discretion. We are not responsible for arrangements left unattended after delivery, including damage from weather, animals, or theft. For deliveries to businesses, hospitals, or funeral homes, arrangements will be left with the receiving department or front desk.
Failed Deliveries
If delivery cannot be completed due to an incorrect address, restricted access, or the recipient's refusal, we will attempt to contact you to arrange an alternative delivery. Additional delivery fees may apply for redelivery attempts.
4. Substitution Policy
Due to the perishable nature of fresh flowers and the seasonal variability of supply, it may occasionally be necessary to substitute specific flowers, greenery, or containers in your arrangement. When substitutions are needed, we adhere to the following principles:
- Substituted items will be of equal or greater value to the original selection.
- We will make every effort to match the overall style, color palette, and aesthetic of the original design.
- If a significant substitution is required (e.g., a different primary flower type), we will attempt to contact you before proceeding, time permitting.
- For sympathy and funeral arrangements, we take extra care to honor the intended sentiment and will substitute with the utmost respect.
- Container substitutions may occur if the specified container is unavailable, and a similar container of equal or greater value will be used.
5. Satisfaction Guarantee & Refunds
Your satisfaction is our top priority. If you are not completely satisfied with your floral arrangement, please contact us within 24 hours of delivery at (256) 237-9579.
Resolution Options
Depending on the nature of the issue, we may offer one or more of the following resolutions at our discretion:
- A replacement arrangement delivered at no additional charge.
- A partial or full credit toward a future order.
- A partial or full refund to the original payment method.
Conditions
- Claims must be made within 24 hours of delivery. We may request a photograph of the arrangement to assess the issue.
- Refunds or credits will not be issued for arrangements that have been altered, mishandled, or not properly cared for after delivery.
- Refunds for event orders (weddings, large events) are handled on a case-by-case basis and may be subject to a restocking or labor fee.
- Delivery fees are non-refundable unless the delivery failure was caused by Lamb's Florist.
Cancellations
Orders may be cancelled without charge if cancellation is requested at least 24 hours before the scheduled delivery time. Cancellations made less than 24 hours before delivery may be subject to a cancellation fee, as materials may have already been prepared. Wedding and event orders are subject to the cancellation terms discussed at the time of booking.
6. Privacy Policy
Lamb's Florist ("we," "us," "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy describes what information we collect, how we use it, how we protect it, and your rights regarding your data.
Information We Collect
We may collect the following types of information:
- Personal Information: Name, email address, phone number, and delivery address provided when you place an order by phone or create an account on this Site.

You may view and download content from this Site for your personal, non-commercial use only, provided you do not modify the content and you retain all copyright and proprietary notices. Any other use, including reproduction, modification, distribution, or republication of Site content without our express written consent is strictly prohibited.
9. User Accounts

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including if we reasonably believe that you have violated this Agreement.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LAMB'S FLORIST, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of, or inability to use, this Site.
- Any products or services obtained through our business.
- Any errors, omissions, or inaccuracies in Site content.
- Unauthorized access to or alteration of your transmissions or data.
- Any third-party conduct on or related to the Site.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE AMOUNT YOU PAID TO LAMB'S FLORIST IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
This Site and all content therein are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless Lamb's Florist, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site, your violation of this Agreement, or your violation of any rights of a third party.
12. Dispute Resolution & Arbitration
Informal Resolution
In the event of any dispute, claim, or controversy arising out of or relating to this Agreement, your use of this Site, or any transaction with Lamb's Florist (collectively, "Disputes"), we strongly encourage you to first contact us directly at (256) 237-9579 to seek an informal resolution. Most concerns can be resolved quickly and to your satisfaction through direct communication.
Binding Arbitration
If a Dispute cannot be resolved informally within thirty (30) days of initial contact, you agree that the Dispute shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be conducted in Calhoun County, Alabama, in accordance with the then-current rules of the American Arbitration Association ("AAA"). The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Lamb's Florist. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Jury Trial Waiver
BY AGREEING TO THESE TERMS, YOU AND LAMB'S FLORIST EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATED TO THIS AGREEMENT.
13. Notice & Cure Policy
Before initiating any legal proceeding, filing any claim, or commencing arbitration against Lamb's Florist, you must provide us with written notice ("Notice") describing:
- The nature and basis of the claim or dispute.
- The specific relief sought, including any monetary damages and the calculation thereof.
- Your contact information, including your full name, mailing address, phone number, and email address.
Upon receipt of such Notice, Lamb's Florist shall have thirty (30) calendar days to investigate the claim and attempt to resolve it in good faith (the "Cure Period"). During this Cure Period, no legal or arbitration proceedings may be initiated. This notice and cure requirement is a mandatory prerequisite to any legal action and is intended to facilitate efficient and amicable resolution of disputes.
14. Governing Law & Jurisdiction
This Agreement and any Dispute arising out of or related to it shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of laws principles. To the extent that any legal action is permitted under this Agreement (outside of arbitration), you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Calhoun County, Alabama.
15. Severability & Entire Agreement
If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from this Agreement. The remaining provisions shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and Lamb's Florist regarding your use of the Site and supersedes all prior agreements, understandings, representations, and warranties, whether written or oral, regarding the same subject matter.
No waiver of any term or condition of this Agreement shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
